Right of Withdrawal

You have the right to withdraw from a contract within fourteen days without giving any reason, provided that you have a statutory right of withdrawal for the specific contract.

The withdrawal period is fourteen days from the date the contract is concluded. The period does not begin before you have been properly informed about the right of withdrawal.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of an unequivocal statement.

To meet the withdrawal deadline, it is sufficient for you to send the notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

You may use the model withdrawal form below for this purpose, but it is not mandatory. Any other unequivocal statement is sufficient. You can also prepare a withdrawal statement as an email using the Prepare withdrawal email page; you must review and send this email yourself.

If you withdraw from the contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no event will you incur any fees as a result of this reimbursement. Any compensation for paid services already provided that is owed by law under section 3 remains unaffected.

For digital content that is not supplied on a tangible medium, the right of withdrawal may expire under the statutory conditions once traMADA has begun performance of the contract. For paid contracts, this requires in particular your express consent to performance beginning before expiry of the withdrawal period, your confirmation that you are aware that the right of withdrawal will expire, and the legally required confirmation on a durable medium. If you withdraw from a contract for the supply of digital content that is not supplied on a tangible medium, you do not owe compensation for that content.

If you expressly requested that traMADA begin providing a paid service during the withdrawal period and you were properly informed, compensation may be owed under the statutory conditions for the service provided up to the time of withdrawal. For off-premises contracts, this additionally requires that you communicated this request on a durable medium. The agreed total price generally forms the basis for calculation; if that price is disproportionately high, the market value of the service provided is decisive. For fully performed paid services, the right of withdrawal may expire only under the statutory conditions, in particular where you expressly consented in advance to performance beginning before expiry of the withdrawal period and confirmed your awareness that the right would expire upon full performance of the contract; for off-premises contracts, consent to commencement must be communicated on a durable medium.
